Michael Kaufman d/b/a Kaufman Lynn, Inc. v. Automobili Lamborghini

Lemon Law Case no. 2005-0912/WPB

Cousins Law Firm represented a prominent contractor in a Lemon Law claim against Lamborghini. The Consumer leased a 2004 Lamborghini Gallardo in Miami, valued at over $188,000. Soon the Consumer experienced problems with the air conditioning system resulting in the vehicle staying at the Manufacturer's repair facility for over 30 days for the defective air conditioner.

The Manufacturer argued that the defect did not substantially impair the use, value, or safety of the Lamborghini. Patrick Cousins defeated the Manufacturer’s argument and succeeded in having the vehicle declared a lemon. Lamborghini was ordered to refund the Consumer the lease payments he made to date and to pay off the lease. The Consumer later purchased a different make of automobile.
